A dispute between the outgoing mayor of Binghamton and the incoming mayor over the recent appointment of a city engineer to a six year term, beginning after the new mayor takes office, may result in litigation over the appointment. Steve Silverberg noted this appears to be a unique situation as the appointment is based upon a referendum that passed on November 5.

Katherine Zalantis was extensively quoted in a new article in Business Insider addressing issues relating to New York’s rules on adverse possession. There is renewed interest in this little known area of the law after a Texas man receive national attention when he was able to obtain ownership of a house by adverse possession.


FIRM SUCCESSFULLY DEFENDS TOWN
3/18/2011

Silverberg Zalantis LLC successfully brought an appeal on behalf of the Town of Haverstraw, defending a sewer connection fee. The Appellate Division Second Department modified the decision of the lower court and granted the Town’s application for summary judgment dismissing the claims relating to imposition of the fee as time barred. Katherine Zalantis argued the appeal before the Court.

4/8/10

In a decision dated 4/6/10, the Appellate Division, Second Department upheld the decision of the Village of Mamaroneck Zoning Board of Appeals, which denied a challenge to the issuance of a building permit for a house which utilized lands underwater to calculate the lot area and floor area ratio. The case was argued in the Appellate Division by Katherine Zalantis.

The firm successfully defended the Village of Pelham Manor in a case, Vinrus Corp. v. Village of Pelham Manor Building Inspector, involving whether a property owner, who failed to comply with a notice from the building inspector, was entitled to a certificate of occupancy. Kathy Zalantis wrote the brief and Steve Silverberg argued the appeal.

ZALANTIS SUCCESSFULLY ARGUES DEFENSE OF MUNICIPAL SEQRA DETERMINATION
5/19/06

Continuing a string of litigation successes, Kathy Zalantis received a favorable decision from the Appellate Division, Second Department this week in Lake Grove Partners LLC v. Middelton. The Court upheld a lower court determination that the Village of Lake Grove on Long Island had taken a proper “hard look” prior to issuing a negative declaration under SEQRA. The decision supports the determination by the Village to modify its business district zoning. For more information on the case please see our Blog.


SILVERBERG SUCCESSFULLY ARGUES APPEAL OF CONTRACT LIABILITY CASE
5/9/06

The Appellate Division Second Department issued a decision in a case argued by Steve Silverberg finding that a client of Silverberg Zalantis LLC is entitled to damages for the breach of a construction contract by a municipality. In Xavier Contracting LLC v. City of Rye, the Court agreed with a lower court ruling that Xavier is entitled to enforce a contract awarded by the City of Rye despite an attempt by the City to cancel the contract before it was signed. ZALANTIS TO PARTICIPATE IN AMERICAN BAR ASSOCIATION TELECONFERENCE

Kathy Zalantis will be a panelist on a teleconference to be held February 16, 2006, which is co-sponsored by the Commission on Women in the Profession, entitled Women and Minority-Owned Law Firms. The purpose of the teleconference is to discuss the obstacles and challenges faced by women and minorities in law firms. Among other topics, the discussion will focus on how women and minorities can build confidence in their abilities to provide services to business clients and demonstrate that small firms can often match the services provided by large firms.


SILVERBERG ZALANTIS RETAINED BY VILLAGE OF TARRYTOWN
10/15/05

The Village of Tarrytown has retained Silverberg Zalantis LLC as special counsel for the purpose of drafting a revised agreement for the development of the Village Aquatic Center. The Aquatic Center is to be constructed as part of the zoning incentives for a major development on the Tarrytown waterfront. The entire project is subject to review under SEQRA and the Village site plan law.

STEVE SILVERBERG PROVIDES RLUIPA AND SEQRA UPDATE

On May 9, 2005 Steve Silverberg spoke at the annual certification course for Zoning and Planning Officials conducted by the Rockland County Municipal Planning Federation. He provided an update on recent RLUIPA and SEQRA cases, including two recent decisions by the Second Circuit Court of Appeals, to approximately 100 attendees.


SILVERBERG AND ZALANTIS LECTURE AT PACE LAW SCHOOL PROGRAM

On March 29, 2005 Steven Silverberg and Katherine Zalantis participated in the annual Land Use Law Update co-sponsored by Pace Law School and the Westchester Municipal Planning Federation.

Ms. Zalantis spoke on cases involving deployment of wireless telecommunications facilities and her experiences as a participant in the two most recent cases on this subject heard by the New York State Court of Appeals.

Mr. Silverberg spoke on cases involving the Religious Land Use and Institutionalized Persons Act (RLUIPA) and its impact on municipal regulation of construction of facilities sponsored by religious groups.
