SILVERBERG QUOTED IN LAWYERS USA RLUIPA ARTICLE

Steve Silverberg was quoted in the "feature article of the week" in Lawyers USA entitled "Holy Wars" which reviewed the current status of litigation over the Religious Land Use and Institutionalized Persons Act (RLUIPA). Silverberg Zalantis had been retained by the Village of Mamaroneck after it lost a RLUIPA appeal in the Second Circuit Court of Appeals. SILVERBERG ZALANTIS NAMED ATTORNEYS FOR VILLAGE OF MAMARONECK

The Mamaroneck Village Board has asked Silverberg Zalantis to be acting Village Attorneys while the Village Board searches for a full time in house attorney.The firm, which has been serving as special counsel to the Zoning Board of Appeals for the past year, will provide services to all the Village's boards, commissions and departments until a new attorney is hired.

Katherine Zalantis has been invited to participate in the celebration of the 30th Anniversary of the Pace Law School Environmental Program by participating as a speaker on the Religious Land Use and Institionalized Persons Act (RLUIPA). The lecture will be one of several CLE offerings held at Pace Law School on Octber 20, 2007 in conjunction with the celebration marking the anniversary of the Environmental Program.
SILVERBERG ELECTED TO SERVE ON ABA LAW PRACTICE MANAGMENT COUNCIL

On August 11, 2007 Steven Silverberg was elected to the governing council of the American Bar Association Law Practice Management Section (LPM). The mission of LPM is to " investigate, evaluate, develop, and disseminate information and techniques which will make the legal services delivery team more effective, competent, ethical, and responsive to the needs of clients and the public". Steve has been active in LPM for several years serving on the Education Board and as chair of the Practice Marketing Core Group.
SEQRA AND RLUIPA LECTURE

Steven Silverberg will be lecturing for the Rockland Municipal Planning Federation at its annual training program for zoning and planning officials in Rockland County on April 30, 2007. Steve will be providing a case law update on SEQRA along with an overview of RLUPA and recent legislation.

The Village Board of the Village of Mamaroneck voted to appoint Silverberg Zalantis LLP as new special counsel to the Zoning Board of Appeals of the Village. Steve Silverberg and Kathy Zalantis will share the duties of advising the ZBA and defending the ZBA in any new litigation.

ZALANTIS SUCCESSFULLY ARGUES DEFENSE OF MUNICIPAL SEQRA DETERMINATION

Continuing a string of litigation successes, Kathy Zalantis received a favorable decision from the Appellate Division, Second Department this week in Lake Grove Partners LLC v. Middelton. The Court upheld a lower court determination that the Village of Lake Grove on Long Island had taken a proper "hard look" prior to issuing a negative declaration under SEQRA. The decision supports the determination by the Village to modify its business district zoning. For more information on the case please see our Blog.
SILVERBERG SUCCESSFULLY ARGUES APPEAL OF CONTRACT LIABILITY CASE

The Appellate Division Second Department issued a decision in a case argued by Steve Silverberg finding that a client of Silverberg Zalantis LLP is entitled to damages for the breach of a construction contract by a municipality. In Xavier Contracting LLC v. City of Rye, the Court agreed with a lower court ruling that Xavier is entitled to enforce a contract awarded by the City of Rye despite an attempt by the City to cancel the contract before it was signed. Each year the Rockland Municipal Planning Federation provides certification classes for Zoning and Planning officials throughout Rockland County. Steven Silverberg has been invited to provide the case law update on SEQRA and RLUIPA at the May 4, 2006 session. This is the sixth consecutive year he has been asked to provide a case law update for the Federation.

Zalantis to Participate in American Bar Association Teleconference

Kathy Zalantis will be a panelist on a teleconference to be held February 16, 2006, which is co-sponsored by the Commission on Women in the Profession, entitled Women and Minority-Owned Law Firms. The purpose of the teleconference is to discuss the obstacles and challenges faced by women and minorities in law firms. Among other topics, the discussion will focus on how women and minorities can build confidence in their abilities to provide services to business clients and demonstrate that small firms can often match the services provided by large firms.
Silverberg Zalantis Retained by Village of Tarrytown

The Village of Tarrytown has retained Silverberg Zalantis LLP as special counsel for the purpose of drafting a revised agreement for the development of the Village Aquatic Center. The Aquatic Center is to be constructed as part of the zoning incentives for a major development on the Tarrytown waterfront. The entire project is subject to review under SEQRA and the Village site plan law.
Leah Murphy Joins Silverberg Zalantis to Develop School Law Practice

Silverberg Zalantis has added Leah L. Murphy as counsel to the firm for the purpose of adding school districts to its roster of government clients. Ms. Murphy, a 1990 graduate of Brooklyn Law School and a former editor of the Brooklyn Law School Law Review has spent the last twelve years representing school districts throughout New York State.

Professor John Nolon of Pace University School of Law chaired a continuing legal education program at Pace Law School, which included Steven Silverberg as one of the speakers. Mr. Silverberg spoke on appropriate conditions that may be imposed by land use boards in granting approvals and questions related to the issue of impact fees.
Silverberg Selected For ABA Committee

Steven Silverberg has been asked to serve on the Education Board of the American Bar Association Law Practice Management Section. The Education Board develops continuing legal education programs for the ABA related to practice management, technology and marketing. It runs monthly teleconferences and programs at ABA conferences throughout the year.

On May 9, 2005 Steve Silverberg spoke at the annual certification course for Zoning and Planning Officials conducted by the Rockland County Municipal Planning Federation. He provided an update on recent RLUIPA and SEQRA cases, including two recent decisions by the Second Circuit Court of Appeals, to approximately 100 attendees.

On March 29, 2005 Steven Silverberg and Katherine Zalantis participated in the annual Land Use Law Update co-sponsored by Pace Law School and the Westchester Municipal Planning Federation.
Ms. Zalantis spoke on cases involving deployment of wireless telecommunications facilities and her experiences as a participant in the two most recent cases on this subject heard by the New York State Court of Appeals.
Mr. Silverberg spoke on cases involving the Religious Land Use and Institutionalized Persons Act (RLUIPA) and its impact on municipal regulation of construction of facilities sponsored by religious groups.
