THE FIRM SUCCESSFULLY DEFENDS THE TOWN OF HAVERSTRAW’S ENFORCEMENT OF A RESTRICTIVE COVENANT LIMITING DEVELOPMENT OF A SITE
SEPTEMBER 28, 2023

Christie Addona successfully argued before the Appellate Division obtaining a decision (https://www.nycourts.gov/reporter/3dseries/2023/2023_04784.htm ) that upheld the right of the Town of Haverstraw to continue the restrictions contained in a covenant entered into when the property at issue was first developed. Citing a Court of Appeals case, handled nearly twenty years ago by Kathy Zalantis and Steve Silverberg, the Court held: ‘“Restrictive covenants will be enforced when the intention of the parties is clear and the limitation is reasonable and not offensive to public policy’ (Chambers v Old Stone Hill Rd.Assoc., 1 NY3d 424, 431).”

ZALANTIS AND SILVERBERG PUBLISH AN ARTICLE ABOUT THE 9TH CIRCUIT DECISION REGARDING FCC REGULATION OF LOCAL REVIEW OF 5G WIRELESS SMALL CELL INSTALLATIONS

Kathy Zalantis and Steve Silverberg authored an article discussing the 9th Circuit Court of Appeals decisions in City of Portland v. United States that upheld most of the orders issued by the FCC, in 2018, placing limits on regulations and fees fixed by local governments,with respect to so called “small cell” wireless installations.The Article appears in the October, 2020 edition of the New York Real Estate Law Reporter.


ZALANTIS BROUGHT IN TO ASSIST ON LONG DELAYED CVS APPLICATION IN NEW PALTZ
AUGUST 1, 2019

For approximately six years, Trans Hudson has been seeking approvals from the City of New Platz for a project that includes a new CVS store. Kathy Zalantis was recently retained to assist in obtaining the approvals. As noted in an article in Hudson Valley One, reporting on the most recent Planning Board hearing entitled “Approval of New Paltz CVS project seems likely“: “Based on her initial posture, Zalantis may have been retained as something of a bulldog, sternly telling board members that they had dragged their feet for far too long.”


SILVERBERG SELECTED AS SECOND VICE PRESIDENT OF THE ROCKLAND COUNTY MUNICIPAL PLANNING FEDERATION

Christie Addona and Steve Silverberg gave a three hour case law update to members of the Rockland Municipal Planning Federation. The program covered recent zoning, planning SEQRA, RLUIPA and other land use cases. The lecture is part of the mandatory certification program taken by members of Rockland County municipal zoning and planning boards.


SILVERBERG PRESENTED ON ETHICAL ISSUES IN LAND USE MATTERS

Steve Silverberg was a speaker at the annual Pace University Land Use Law Center Program on “Ethics in Land Use: Guiding Principles for Attorneys and Land Use Board Members.” The program focused on ethical issues facing attorneys who represent and appear before land use boards, as well as ethical issues facing land use board members.

A recent decision by the Appellate Division of the New York State Supreme Court appears to have changed the rules for municipalities charging consultants’ fees to applicants before land use boards. In an article published in the December issue of the New York Real Estate Law Reporter, Kathy and Steve discuss the decision and some of its implications.

Christie Tomm Addona and Steve Silverberg provided an update of case law and regulations relating to zoning and land use for Rockland Municipal Officials, including planning board and zoning board members, on behalf of the Rockland County Municipal Planning Federation. They provide this three hour continuing education program twice each year summarizing the most recent court decisions, statutes and regulations relevant to planning and zoning boards, including site plans, subdivisions, variances, special permits, SEQRA and RLUIPA.

Genoa Charter Twp., 858 F.3d 996, 998 (6th Cir. 2017), cert. den. — S.Ct. —-, 2018 WL 1994815 (Mem), where the circuit court appears to have set a new standard to permit denial or religious uses in certain circumstances.

Steve Silverberg assisted JSL Madison LLC in receiving approvals for a zoning map change, site plan and special permit approval for adaptive reuse of a former church property, to be converted to an Aqua Tots Swim School. At the annual awards dinner held by the Westchester Municipal Planning Federation, the Village of Mamaroneck received a planning achievement award for the project.

Steve Silverberg will speak at a session of the Municipal Law Section of the Westchester County Bar Association on September 29, 2015 regarding the impacts on municipalities of the recent Supreme Court decision in Reed v. The Town of Gilbert. The presentation is entitled “Reed v. Gilbert-Why More Than Your Sign Ordinance May Be Unconstitutional.”
